Ecologistic Spa with headquarters in Via San Francesco, n.26 - 74011 Castellaneta (TA) - Italy, P. IVA IT02682630732 - Business Register of Taranto n. 03050620735 - REA TA-188745 , makes available to all users the possibility of purchasing a selection of articles (hereinafter "Products") via the website www.boxlum.it (hereafter "Site") of which Ecologistic Spa is the sole and exclusive owner.
ARTICLE 1: CONCLUSION OF SALES CONTRACTS
The confirmation and sending of the order by the customer ("Customer" means the user of the site www.boxlum. it that accesses the e-commerce check-out), according to the instructions that from time to time appear on the web pages, involves the reading and the complete acceptance of the present general sales conditions by the Customer. The sales contract between Ecologistic Spa and the Customer is considered completed with the acceptance of the order by Ecologistic Spa.
If the Customer is a consumer (a person who buys goods for purposes not related to his professional activity, or makes the purchase without indicating in the form of order a VAT number reference), once the online purchase procedure has been completed, it will print or save an electronic copy and in any case keep these general sales conditions, in compliance with the provisions of articles 3 and 4 of the D. Leg. 185/99 on distance selling.
Any right of the Customer to compensation for damages or indemnity is excluded, as well as any contractual or extra-contractual liability for the non-acceptance, even partial, of an order, in as the non-acceptance of the order or the lack of authorization of the payment transaction do not determine costs borne by the customer.
ARTICLE 2: PURCHASE METHOD
The Customer can only purchase products in the online catalog at the time the order is submitted and can be viewed online at www.boxlum. it as described in the relevant information sheets.
The order will be validly processed upon receipt of the order confirmation and authorization to debit the order on the e-mail address communicated by the Customer. Price and transport costs, as better foreseen in the following art.5.
The image accompanying the description of a product may not be fully representative of its features but may differ in color, size, and accessory products shown in the figure. All purchase support information is intended as a simple generic information material, not referable to the real characteristics of a single product.
Correct receipt of the order is confirmed by Ecologistic Spa via an email reply, sent to the email address electronic communicated by the Customer. This confirmation message will contain date and time of receipt of the order and a customer order number to be used in any further communication with the Customer Service of Ecologistic Spa The message once again all the data entered by the Customer, all information relating to the essential characteristics of the property, the indication of the price, the payment methods, the methods and delivery costs and applicable taxes. The Customer must verify its correctness and promptly notify any corrections, in the manner described in this document.
In case of non-acceptance of the order, Ecologistic Spa guarantees timely communication to the Customer.
ARTICLE 3: PRICES
The products will be sold at the prices indicated in the online product sheet at the time the order is confirmed by the Customer. Delivery costs are charged to the Customer and will appear on the cart page before completing the payment. Before the Customer confirms the order by clicking on the appropriate payment button on the dedicated web page, a summary of the prices of the products loaded on the cart will appear, as well as the taxes and delivery costs. These data will then be automatically reproduced on the order receipt that Ecologistic Spa sends to the Customer following the order confirmation procedures.
ARTICLE 4: TAX DOCUMENTATION AND DELIVERY METHOD
For each order accepted and made, Ecologistic Spa issues a sales receipt or invoice to the Customer. Ecologistic Spa also issues an invoice to the customer who requests it on the web page, before completing the purchase. The invoice will be sent by e-mail to the order holder, pursuant to Article 14 of the D.P.R. 445/2000. For the issuance of the invoice, the information provided by the Customer when ordering will be used. No change in the invoice will be possible after the issuance thereof.
ARTICLE 5: PAYMENT METHOD
The Customer can make the payment by Credit Card / Prepaid through PayPal account and by bank transfer in advance. With regard to payments by payPal or Credit Card / Prepaid, together with the order by the Customer, the PayPal circuit will authorize the commitment of the amount relating to the order placed on the PayPal account or on the credit card / Prepaid of the Customer. In the event that the Customer exercises the right of withdrawal, in the manner defined in the following Article 6, Ecologistic Spa will return the amount previously debited to the exclusion of the shipping costs already incurred.
At no time during the purchase process Ecologistic Spa is able to know the information relating to the Customer's credit card , transmitted via secure connection and no computer archive of Ecologistic Spa will keep such data.
ARTICLE 6: RIGHT OF WITHDRAWAL
According to the art. of the legislative decree 6 September 2005, n. 206, as modified by the D.Leg. 21.02.14 n ° 21 (the "Consumer Code"), if the Customer is a consumer (ie a natural person who buys the goods for purposes not related to his professional activity, or does not make the purchase with a reference of Partita VAT), has the right to terminate the purchase contract for any reason, without having to provide explanations and without any penalty within 14 days of receipt of the purchased Product.
Ecologistic Spa , to protect its customers, allows instead to exercise this right, within 30 working days from the date of receipt of the goods, by written notice of withdrawal addressed to the address firstname.lastname@example.org .
Once the above-mentioned withdrawal notice has been received, the Customer Service of Ecologistic Spa will quickly inform the Customer of the instructions on how to return the goods. The consumer must return the Product (s) by delivering it directly to the seller or to a third party authorized by the seller to receive them, without undue delay and in any case within fourteen days from the date on which he communicated to the seller his intention to withdraw from the contract. / p>
The direct shipping costs related to the return of the Product are charged to the Customer.
The purchased Product must be returned in its entirety and complete, with all accessories and any spare parts, in the original packaging, complete in all its parts (including packaging and any documentation, etc ...).
The Customer can manipulate the Product in order to establish its nature, characteristics and functioning but is responsible for the decrease in the value of the Product resulting from a different handling from the strictness necessary for this purpose.
If the Customer withdraws from this contract, he will be reimbursed for all payments he made to Ecologistic Spa , excluding delivery costs and cash on delivery, and this at the time the Product has been returned to the Ecologistic Spa warehouse. These refunds will be made using the same payment method used for the initial transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not incur any fees as a result of such reimbursement.
ARTICLE 7: GUARANTEE AND COMPLAINTS
All products sold by Ecologistic Spa are covered by the manufacturer's standard warranty pursuant to Legislative Decree 206/05. To use the warranty, the Customer must keep the receipt of the order confirmation that he received by email.
The exercise of the Guarantee may include the request for assistance to the authorized service centers in the area and / or follow the methods illustrated in the documentation present within the product packaging.
The manufacturer's standard warranty is provided in the manner illustrated in the documentation included in the product packaging. If, as a result of an intervention by an Authorized Service Center, the defect is not covered by the manufacturer's standard warranty, the Customer will be charged for any costs of verification and recovery required by the Authorized Assistance, as well as transport costs, if supported by Ecologistic Spa .
The substitutions in case of product not working on delivery take place only if expressly provided by the manufacturer. The timing of replacement or repair of the product depends solely on the policies of the manufacturer.
In the event that, for whatever reason, Ecologistic Spa was not able to render to its customer a product in warranty (restored or replaced) may at its discretion return the amount paid taking into account the use of the asset or replacing it with a product of equal or superior characteristics.
The timing of repair or possible replacement of the product depends exclusively on the policies of the manufacturer and no damage can be requested to Ecologistic Spa For any delays in repairs or replacements.
In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.); to limit damage to the original packaging, we recommend inserting it in a second box; in all cases, the attachment of labels or adhesive tapes directly onto the original product packaging must be avoided.
The Customer will be given an authorization number when the product returns, which must be indicated on the outside of the packaging, following the instructions provided directly in the relative authorization e-mail
ARTICLE 8: PRIVACY
We hereby inform you that, pursuant to and for the purposes of art. 13 of the legislative decree 30.06.2003 n. 196, the personal data that will be provided by the Customer to Ecologistic Spa are treated by the same, also with automated methods, for inclusion in the customer archive and are necessary for the possible conclusion of a contractual relationship and for subsequent civil, fiscal and management obligations. The data may also be used for statistical extrapolations and commercial and promotional communications, without prejudice to the Customer's right to communicate at any time the desire to no longer wish to receive such communications.
The provision of data is optional, but in the absence of this it will be impossible to enter into a sales contract and therefore to accept the order.
We inform you that, in relation to the provisions of art. 7 of the Legislative Decree above, the Customer will have, among other rights, the right to obtain:
- confirmation of the existence of personal data concerning them;
- the deletion, transformation into anonymous form or blocking of data processed in violation of the law;
- updating, rectification or integration of data.

ARTICLE 9: APPLICABLE LAW AND JURISDICTION
This contract is governed by Italian law.
For the solution of civil and criminal litigation deriving from the conclusion of the present Contract, if the Customer is a consumer, the territorial competence is that of the reference forum of the his Municipality of residence; in all other cases the territorial jurisdiction is exclusively that of the Court of Taranto.
